Terms and Conditions – Marif

  1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Marif mobile application, website, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.

  1. Eligibility

You must be at least fifteen (15) years of age to access and use the Platform.

If you are under the age of eighteen (18), you may use the Platform only under the supervision and with the consent of a parent or legal guardian. The parent or legal guardian shall be fully responsible for your use of the Platform, including any transactions, bookings, or obligations incurred.

By allowing a minor to use the Platform, the parent or legal guardian agrees to be bound by these Terms and Conditions on behalf of the minor and assumes full legal responsibility for all activities conducted through the account.

  1. Nature of the Platform

Marif operates strictly as a digital intermediary platform that connects users with independent service providers, including salons, clinics, beauty professionals, and home service providers (“Providers”). Marif does not provide services directly and bears no responsibility for service execution, materials used, or outcomes.

  1. User Accounts

Users are responsible for maintaining accurate account information and safeguarding login credentials. Any activity under your account is your responsibility. Marif reserves the right to suspend or terminate accounts involved in misuse or violations.

  1. Bookings and Service Relationship

When a booking is confirmed, a direct contractual relationship is established between the user and the Provider. The Provider is solely responsible for delivering the service, including quality, safety, compliance, and results. Marif’s role is limited to facilitating bookings and payments.

  1. Payments and Financial Transactions (Payment-In)

All payments are processed through secure third-party providers. By completing a transaction, you authorize Marif to process payments on your behalf. Users are responsible for providing accurate payment information.

  1. Wallet System

Marif may offer a digital wallet for storing funds. Wallet balances are non-withdrawable, non-refundable, and can only be used within the Platform. Marif reserves the right to review and correct wallet discrepancies.

  1. Pricing, Fees, and Commission

Service prices are determined by Providers. Marif does not guarantee price consistency outside the Platform. A service fee may apply and will be clearly displayed. Marif may deduct commissions from Providers.

  1. Gift Cards and Promotions

The Platform may offer promotional codes, discounts, and gift cards. These are subject to conditions, may have expiration dates, and are non-transferable and non-refundable. Equivalent service substitution may apply if services become unavailable.

  1. Cancellation, Refunds, and Deposits

Cancellation policies vary by Provider. Prepaid bookings may be refunded to the wallet if cancelled within allowed timeframes. Certain services may require a non-refundable deposit (e.g., 20%).

  1. Provider Compliance with Laws and Regulations

Providers must fully comply with all applicable UAE laws and regulations, including those issued by MOHAP, the Department of Health, and municipal authorities. All services must be delivered within valid licenses and approved legal frameworks.

  1. Use of Approved Materials and Religious Compliance

Providers must use only approved, safe, and authorized materials in all services offered through the platform. The use of any prohibited, non-compliant, or harmful substances or ingredients is strictly forbidden. Providers must also comply with all applicable cultural, religious, and regulatory standards within the United Arab Emirates.

The Merchant is strictly prohibited from offering, performing, listing, or advertising any of the following services on the platform:

  • Hair extensions or hair linking (“wasl”) in any form;
  • Eyelash extension (permanent)
  • Nail extension (permanent)
  • Eyebrow plucking (namas) or any similar practice.

Only permissible alternatives—such as trimming or cutting of hair and eyebrows provided they comply with applicable laws and regulations.

Any violation of this clause may result in immediate suspension or termination of the Provider’s account, removal of the non-compliant services, and any other actions deemed necessary by the platform.

  1. Medical, Laser, and Specialized Services

Providers may not offer medical, therapeutic, or laser services unless properly licensed by competent authorities. Any violation is solely the responsibility of the Provider.

  1. Health, Safety, and Service Standards

Providers must maintain high hygiene, sterilization, and safety standards. They are solely responsible for service quality, accuracy of information, and professional conduct. Misrepresentation or unsafe practices are strictly prohibited.

  1. Data Protection and Confidentiality

Providers must comply with UAE data protection laws and maintain strict confidentiality of user data. Any misuse, disclosure, or breach of personal data is the sole responsibility of the Provider.

  1. Platform Rights, Monitoring, and Intellectual Property

Marif reserves the right to monitor activity, suspend accounts, and remove content that violates these Terms. All Platform content, trademarks, and branding are owned by Marif and may not be used without authorization.

  1. Limitation of Liability and Indemnification

Marif bears no liability for services provided by Providers, including any damages, errors, injuries, or regulatory violations. Users and Providers agree to indemnify and hold Marif harmless from any claims arising from use of the Platform.

  1. Limitation of Liability for Indirect or Consequential Damages

Notwithstanding anything to the contrary set forth in these Terms and Conditions, the Privacy Policy, or any other applicable agreements, and except for any agreed cancellation or delay fees, Marif shall not, to the fullest extent permitted by applicable law, be liable to any party for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of, or inability to use, the Platform.

Such excluded damages include, without limitation, loss of profits or revenue, loss of customers, reduced demand, reputational harm, loss of bookings, service interruptions, system failures, technical disruptions, loss of opportunities, or increased operational costs.

This limitation of liability shall apply whether such damages were foreseeable or unforeseeable, and whether arising from technical, operational, or other causes, without prejudice to any liability that cannot be excluded under applicable law.

  1. Intellectual Property and Operating System Protection

The Other Party acknowledges that all intellectual property rights related to the (Marif ) application—including the booking management system, workflow structure, operational mechanisms, design framework, service display methods, user interaction models, and any functional or technical components used within or connected to the application—are the exclusive property of the First Party.
The Other Party agrees not to copy, imitate, reproduce, or replicate the system or any part thereof, whether directly or indirectly, and by any means, including creating any application, platform, or system that provides a similar operating method or relies on the same functional or operational approach.

In the event that the Other Party copies or attempts to copy the booking system, workflow, or any component of the application, the First Party has the right to take all necessary legal actions, including claiming financial compensation for direct and indirect damages, and immediately ceasing any unauthorized use without the need for prior notice.

  1. Governing Law, Dispute Resolution, and Acceptance

These Terms shall be governed by the laws of the United Arab Emirates, and the courts of Abu Dhabi shall have exclusive jurisdiction over any disputes. By using the Platform or registering as a Provider, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
